Putting An End To Pregnancy Discrimination

California workers are protected by law against discrimination on the basis of pregnancy, childbirth or pregnancy-related medical conditions. Examples of pregnancy discrimination include:

  • Termination or refusal to hire a woman because she is pregnant
  • Involuntary job transfer or elimination of job duties
  • Denial of lawful pregnancy leave
  • Refusal to reinstate a new mother or father to her/his prior position after returning from parental leave
  • Denial of leave to bond with a child after adoption

You are also offered certain rights and protections regarding medical conditions that arise as a result of your pregnancy. Under the California Pregnancy Disability Leave (“PDL”) law, employers must provide up to four months of disability leave to women who are disabled due to pregnancy, childbirth or related medical conditions — which may include morning sickness, bed rest, time off for prenatal care or post-partum depression.

Separately and independently, a mother or father may be eligible for leave under the California Family Rights Act (“CFRA”), allowing for up to 12 weeks to bond with a baby.
